Can You Sue a Doctor for the Wrong Diagnosis ? All About Misdiagnosis If you are the type of person that gets sick pretty often, you probably had at least one misdiagnosis during your life. Sometimes this doesn’t affect you that much, but there are times when a wrong diagnosis can ruin someone’s life. So what can you do in that case, can you sue a doctor for the wrong diagnosis ? Yes, you actually can sue a doctor for the wrong diagnosis, and you should! If a doctor tells you that you have another illness or injury than the one you actually have, he did a misdiagnosis and this is called a medical malpractice. As this can ruin your life (in some cases even kill you), you have all the rights to sue that doctor. The “umbrella” term for this legal area is often called “the personal injury law” and is one of the most important laws in the medical world. If someone misdiagnosed you and nothing bad happened, they will get a civil case, but if it’s found that the doctor misdiagnosed you on purpose or that you or someone else died because of that malpractice, the doctor will get a criminal case. What Is Misdiagnosis and What Can You Do About It? The term “misdiagnosis” is used for when a doctor either misread your test results or guessed that you have a different illness than you actually have. One wrong diagnosis can : • Worsen your medical condition (an example of that is when a doctor gives you a different treatment and you end up having a heart attack). • Prolong the right diagnosis (an example of that can be : a person seems to have kidney stones and gets treated for them. Only a few hours after the procedure starts, the doctor realizes that the patient actually has appendicitis and switches the treatment) • Result in you getting harmed or dying (in the legal world, it’s known as “wrongful death). Cases of wrong diagnosis may also be considered valid if a doctor is not be able to give you a diagnosis for your illness. There are also situations when the hospital or the pharmacy will be considered faulty. All of these points violate the Medical Standard Of Care that should be respected at all costs by a real doctor. Medical negligence is not an act that can be excused and a trained professionist should not fail in helping you. But, in order for you to be able to sue a doctor for wrong diagnosis and win, the doctor’s misdiagnosis must have caused an injury or a death, otherwise you have small chances of winning, but it depends on each individual case. What Common Misdiagnoses Are There ? One out of twenty patients get misdiagnosed, so, mathematically speaking, doctors have a good success rate, which is 95%. But judging by the fact that a misdiagnosis can mean that a disease goes untreated for a prolonged time or that a patient, a human being gets treated in a wrong way, it’s not acceptable. Some misdiagnosis that are common in the medical world are : • Asthma is often a misdiagnosis for recurring bronchitis, that’s why you should consult multiple doctors. • A Heart Attack can be a misdiagnosis for indigestion or panic attacks, thus you should be really careful. • Lyme Disease can be a misdiagnosis for depression, mononucleosis or the flu, which is yet another reason to pay a close attention to your diagnosis. • Alzheimer’s can be a misdiagnosis for Parkinson’s, stress or a stroke, even if the diagnosis is given by a well known doctor. • Lupus is misdiagnosed as fibromyalgia, rheumatoid arthritis or chronic fatigue more often than you’d think, even if they are not that similar. What Can You Do If You Feel Worse After Seeing A Doctor ? If you feel really bad, you can go to an emergency room or to urgent care right away, but do not forget to tell them about what treatment you had. Getting healthy is the most important thing, your attorney can help you with the case so you won’t have to worry about it. The people from the emergency room along with your attorney will tell you to : • Don’t follow your doctor’s orders if you see no improvements or if your condition gets worse because of his/ her actions. • Don’t wait if you feel like you need additional health care. • Don’t wait until your health is at risk or if you feel like it. • Do not wait because your doctor told you to, the most important thing is your health, so if you feel like they are not doing a good job, leave. Those things are called “Mitigating Damages”, when it comes to a medical malpractice, both the patient and the doctor will be as carefully reviewed as possible, in order to avoid any legal mistakes, many cases can turn out in the favor of the doctor, thus the judges must be sure they make the right call. The Judges must be sure that you are not committing a fraud by making your illness or injury with the purpose of winning the trial. If you ever need different health care, you SHOULD get it as fast as possible There are some instances where you can take your first injury or illness to trial against the doctor, but the injuries that happen while you are waiting can not be a part of the trial. If those new injuries happen, they will be a part of your own responsibility. If you have an attorney besides you from the start, it will help your case more and may prevent some problems that can come in time. How To Prevent Being Misdiagnosed A misdiagnosis is not good for any of the parts, but sometimes mistakes can happen, even if you are very careful. In order to reduce some of the risks of you getting […]

Here are the best 5 ways to reduce tax without changing anything in your will. Here are 5 ways on How To Cut Your Inheritance Taxes : 1. How To Leave Your Assets As A Gift In Your Will You might be able to win against Inheritance Tax by simply giving away your estate, setting up a trust or changing your will. But be careful to pay attention to any legal consequences you may have afterwards. If you are married or are in a civil partnership, you can give anything you own at the moment to your wife/husband or civil partner, in some states or countries this will not be possible if the other person was not born in the same country or the amount you may be limited to a specific amount. Using this method you will not have to pay Inheritance Tax on the price of the gift/s. Some of the rules when gifting are complicated so you might need to take some legal advice. 2. How To Give Your Estate To Your Family Or Friends The second advice on How To Cut Your Inheritance Taxes is : When you give anything to one of your friends or a family member that you are not married to, the price of the gift will still be included in your Inheritance Tax for your assets, but only for the next 7 years. Thus, if giving your children some money and then living more than 7 years, it will not be taken into consideration when calculating the inheritance tax after your death. The catch is that you can give away only limited amounts of money every single year so that you will not have to pay inheritance tax. So, you can give away no more than $3000 a year, but you can give to your children and/or grandchildren when they are getting married. But the thing is that you need to be aware of Capital Gains Tax as sometimes you may need to pay for certain estate. The safest route is by checking with your lawyer or accountant if you are not sure if you need to pay Capital Gains Tax or not. 3. How To Put Your Assets Into A Trust The third advice on How To Cut Your Inheritance Taxes is : If you put in a trust a part of your money, property or things that you have invested into out of witch no children of yours or spouse will be able to benefit from, you will no longer need to pay Inheritance Tax for it. So, you can set up a trust for your legal (over 18) children, pay for your grandchildren education or even pay for a family member’s medical bills. You can make a trust right now or you can put it in your will. How To Make Your Will – Step By Step Guide There again can be Capital Gains Tax consequences if you transfer certain estate into a trust during your life, but no Capital Gains Tax will exist if you create a trust in your will Keep in mind the fact that a few types of trusts can be subjected to their own tax regimes and the trust might be subjected to its own inheritance tax. Also, persons that benefit from a trust are likely to have to pay 45% on Income Tax and 28% Capital Gains Tax. Some rules about trusts can be complicated so you should seek advice from an expert. 4. How Leaving Something To Charity Will Help You Not Pay Taxes The forth advice on How To Cut Your Inheritance Taxes is : Everything that you give to a charity will be free of inheritance tax, thus it can be a good way to reduce your inheritance tax, and at the same time do a good cause. If you are going to leave 10% of your assets to charity, it will cut how much inheritance tax is due on the rest. That way, the calculation rate for the inheritance tax sill be only 36%, instead of 40%. The rate is going to be against the balance of the assets that exceed $325 000, but it can be lowered by gifting certain assets. You may think that this is not a big saving, but it means that your family and your friends are going to receive more stuff than they would otherwise, and at the same time a charity will also benefit. 5. How To Take Out Life Insurance And Reduce Tax If you are going to take out the life insurance policy, it will not reduce the amount of inheritance tax to pay on your estate, but the payout may make it easier for your family and/ or friends to pay the taxes. It can mean that because of this they will be able to prevent the family house from being sold If you are going to do this step, you need to make sure that the life insurance payout will go into a trust, in contrary, it will make your estate bigger and they will have to pay even more.
How To Make Your Will – Making your will Before making your will, you need to think wisely about who do you want to leave your things to and how much do you have to leave. Our simple guide will help you understand the basics and write a good will. Step-By-Step Guide On Creating Your Will Prior to you writing a will, you first need to decide on what everyone will get. You need to set all of the basics and plan the repartition of your money and possessions prior visiting a solicitor or discussing your will with the entire family. Do not worry, it’s not as hard as it may sound, it’s actually pretty simple, you just need to follow out step-by-step guide. How To Make Your Will : 1. How To Make A List Of Who You Want To Benefit From Your Property If you want to know How To Make Your Will, the first step will usually take only a few minutes, you can do it anywhere. You may want to include: • Your truest friends • Some charities that you find helpful to humanity • Your life partner or spouse • Your children or some of your other family members All of these people (and charities) can also be called beneficiaries. 2. Estimate The Worth of Your Assets And Property This is the second part on How To Make Your Will. You need to firstly begin with your assets as they are easier to estimate : • Your savings. • Your valuable objects, this includes jewellery, heirlooms, computers, phones, cars etc.. After this, move on to the thing that can change their value over time, inflation etc.. These will be a bit harder to estimate accurately, but it can be done. These might include: • Your pension or salary. • Your business or businesses if you have any. •Your stock market investments, like shares, bonds and / or funds. • Your property, this includes your house and any investment properties, land, and/or even a parking space that you have the partial or full rights of. Remember to take into consideration the value of any debts you may have secured against your property. At last, you need to think about your most precious stuff, in the sentimental sense, as you may want to give those to particular people that you love/trust. The inclusion if your pensions and/or salary can depend on the rules which affect it and you will need to check it beforehand. If you are able to include your pension, the estimation of it may take some calculus. Its value depends on when you are going to die. The first things at which you need to stop and think a little are the benefits from the Pensions Advisory Service. 3. How To Split Your Money And Property When Making A Will This is the third step on How To Make Your Will, it’s another important step before making a will, thinking about how you will split your money and property. There are about 5 types of legacy that you can leave in your will. • “I will leave $3,000 to my daughter” – this is usually called a ‘pecuniary bequest’. It means that you will leave a fixed amount of money. • “I leave my jewellery and heirlooms to my wife” – this is usually called a ‘specific bequest’. It means that you leave a specific item which you own entirely or partially. The way of identifying it will be to see what meets that description criteria at the moment of your death. If you have no jewellery and hairlooms at that time, nothing will be received by your wife. • “I will leave half of my estate to my sob” – this is called a ‘residuary bequest’, which means that you will leave an exact percentage of your estate’s worth at the moment of your death, after all the debts debts, costs, liabilities, legacies and taxes have been paid. • “I will leave my part of my house to my wife if I die before her, but if she dies before me, it will then pass to my son”. This will be called a ‘reversionary bequest’ for your son, it specifies what should happen if the person you left your belongings to dies. • “I will leave my part of my house to my wife for the rest of her life and it will pass to my son at the moment of her death”. This is commonly called a ‘trust’ over that part of the house. The trust allows allows you to choose who will benefit from your property after your death and who will benefit from your belongings once the first person dies. This type of leaving can go wrong quickly, that’s why you need to get some legal advice if you want to include or not a trust in your will. If your dealings are not that complicated, it’s usually better to simply use a residuary bequest. If things are not that simple as usual, you may need to use a combination, such as : John is married and has one daughter. His wife also has a daughter from a previous marriage. He is leaving : • His part of the house goes to his wife until she dies. • $2000 to each grandchildren he has. • Everything else he owns to a charity of his choosing. Dorothy is a widow that has three children and 5 grandchildren. Her only daughter has mental problems. She is leaving : • $700 to each of her grandchildren • Half of her estate in a trust to her daughter until she dies, then it will be split among her sons, but if a son dies before her, that son’s children are going to receive the dead son’s quarter share of the estate between them. 4. Do You Need To Pay Inheritance Tax ? Usually, you don’t need to pay any taxes for : • The […]
10 Ways To Spot A Liar – How To Know If Someone Is Lying Lying is a taboo subject for the big majority of human beings. We are continuously fed with “you should not lie”, “lying is bad”. However, there comes a point in everyone’s life when a “white lie” is necessary for maintaining friendships and relationships, and I’m not only talking about the “I do love your haircut today”. The saying “lies have legs” and the popularization of it makes our subconscious have in it the idea that liars are always caught, that’s why you should always tell the truth. But, even tho this thing sometimes happens, the chances of it happening are not higher than not happening. We, as humans, lie every single when we are in social situations. “I’m only late because I got caught in traffic” when you, in fact, could not decide what clothes to wear. However, there are some lies that are more serious in nature than the ones I just described. For example, there are tons and tons of scammers that abuse their lying capacity and the fact that some people are prone to trusting strangers in order to make a huge profit for themselves at other people’s expenses. For this reason, it’s better to have the ability to recognize liars when you see them. There is no exact science, but here we have ten tips that can make you spot a liar. How to spot a liar: 1. How A Liar Selects His Words Carefully If you ever asked a liar at least one direct question you may have noticed that at first, the liar does not want to directly lie about a subject, therefore he will not give you a direct answer at first. A liar selects his words carefully so that he does not tell the truth when asked, as that may hurt either his pride or his intentions. That’s why, in order to be a liar you don’t necessarily need to say something that is not true, you can simply avoid questions. 2. How a liar uses the Quadi-Denial technique A liar that is aware of the fact that he lies, knows beforehand that he is about to tell a lie. Because of that, he or she does not want to look too convinced of anything, because that can lead to you being suspicious of the fact that you are being lied to. A liar always tries to disguise his answers in pure uncertainty. However, he can unknowingly betray himself by using quasi-lies. One example of that is “I may be wrong, but I believe that this will be the hit of the century”. 3. How a Liar Adds Comments To Disguise His Lies On the same spectrum to the quasi-denials, liars can use qualifying words. This means that the liar is trying to prove the fact that he or she is innocent by adding an additional message. In this aspect, the adding is intended to qualify his words in the most proper way possible. A common example that can help you on how to spot a liar is : “From what I know, your wife is not sleeping with your best friend” 4. How A Liar Uses Softening Words Different from the fabric softeners, a liar uses an aiming vocabulary that is mostly designed to cover up a crime. This type of vocabulary can be a big indicator that the person in front of you is lying. A person that is innocent will respond to a crime with some harsh, judging words. Stealing, maltreatment and fraud are some words that no one wants to be accused of, liars are no exception. A true liar sees the whole wide picture, not just a spot, and that can be seen in his or her words. For a liar there is no such thing as stealing, for him there’s borrowing. For a true liar there is no fraud or mistreatment, there is just good convincement. A liar can actually believe that it can be taken as a simple mistake, not a real crime. 5. How Liars Use Exaggerated Formal Language Another verbal sign for spotting liars is the fact that they use way too much formal language. Liars usually have their lies prepared before saying them, that’s why they are able to articulate them in a more formal manner than you would normally do. So, the fact that someone speak in very eloquent manner might indicate that the person you are speaking to is a big liar, more so if he had the time to overthink it. Innocent people rarely use words that sound official.
7 Reasons To Start Using Google Keep in 2020 In this article let’s talk about Google Keep or Keep Notes. You remember Google Keep, don’t you? It was supposed to revolutionize taking and organizing notes in 2013, but it has faced a lot of competition in the meantime. There are, of course, plenty of productivity and organizational apps that can easily help you keep your life on track across multiple devices. Evernote may be the choice of multiple editors for note-taking, but G Keep has its benefits as a free, minimalist tool, simplifying the process of sharing ideas across multiple devices in real time. For example, you can write down notes in Keep on your IOS or Android device while in a car, and pick it up later on your computer. Or, when you are about to head out to an appointment or meeting of some kind, add some info (such as addresses or directions) on the web app from the computer so you can access them on the road from your phone. You can also keep track of tasks with many to-do lists that can be added to or checked off from multiple screens that get actualized whenever you connect to the internet. So if you never used Google Keep, or you had no idea it exists, there are a lot of reasons for giving it a try. Down below you will get a better sense of what Google Keep offers to every user, and how you can better organize your notes with it. I. You Can Easily Copy Everything to Google Docs One of the the best benefits that G-Keep has to offer is its seamless integration with the whole Google ecosystem. So if you are the type of person that relies heavily on Google Drive, Gmail or even Google Docs, you can share items in Google Keep between platforms having no trouble whatsoever, from inside the Keep app or even through a Google program that supports it, even a normal browser should work. If you are using the app, all you have to do is tap on a note, select the three-dot menu and then choose “Copy to Google Docs”. A small notification will tell you that the note is being saved to your docs, then a new notification will appear with a link to a Google Doc that contains your specific Google Keep data. You can also import items from G Keep by tapping on the Keep icon on the right side of your screen. This action will open a side menu that’s filled with all of your notes and images, and this can be added to Gmail, Drive folders, or even existing documents. You can either use the item’s three-dot menu or drag it into place with your mouse. II. Share and Collaborate With Others Using Google Keep Share and collaborate is one of the Reasons To Start Using Google Keep. Items in your G-Keep app can be shared directly with others without going through the average share menu you can see in other programs. All you need to do is select a note or image you wish to share and choose the person’s icon. You will then be able to add a user’s Gmail address or their name from your contact list. This action will turn you both into collaborators. Now if any of you makes changes to a note, edits will automatically be visible to all the people with whom it was shared, but the original owner can revoke access to anyone at any time. III. The Keep Widget Is Always On and Live (How to use it) You can add a widget to your phone’s home screen for easy and quick access to all of your notes. Depends on the size of the widget you choose, but recent notes can be viewed right on the home screen without opening even the app, it’s as simple as it can get. You can add the Android widget by long- pressing on any of your google keep’s space on the phone’s home screen by tapping the Widget button, then select Keep. On iOS, just swipe right from the home screen into “Today View”, then scroll down, and tap “Edit”. Find then the Google Keep widget and simply tap the plus button to add it. To do so, simply click on an uploaded image, then click on the three-dot menu and select “Grab image text”. All of the text within that image will then be converted into editable and searchable text. This function is perfect for digitizing information from business cards, signs of interest, and / or pieces of paper. Do you trim the exterior parts of dry aged meat ? As beef consumption continues to increase globally, the demand for high-quality beef and beef products is naturally increasing too. Many people desire dry-aged beef because of its unique, characteristic, aged, beefy and roasted flavor and tenderness. Dry aging became well-known method that enhances meat quality, especially flavor, and is a feature of some high-end restaurants. Dry-aged beef is commonly produced when the beef is stored in a refrigerated condition (approximately 2℃–4℃) for 1–5 week without any packaging. The meat surface directly contacts air and readily dries. The surface of dry-aged meat is termed crust. The crust is considered waste and is usually trimmed off. Undesirable characteristics of crust for consumption include hardness, dryness, and presence of a large number of microorganisms. Specialists reported that trim loss of dry-aged beef strip loin exceeds 34% after twenty eight days of aging. The amount of discarded crust will increase as the production and consumption of dry-aged beef increases. This represents a huge economic loss. The exterior part of the dry-aged beef, also called the crust is inevitably forming on all dry-aged meat and is usually trimmed and discarded before being sold, but not always. From my experience, most people say that the crust is rotten meat and should always be thrown away, but letting my nose be the judge I came to the conclusion that it’s impossible to be rotten. We conducted an experiment with this kind of meat, the aim of this study was to explore and find out methods for utilizing that crust. Trimmed vs Non Trimmed Dry-Age, is there any difference in taste? We dry-aged four sirloins for 30 days at 3-4℃ (75-77% relative humidity) with this question in our minds : do you trim the exterior parts of dry aged meat ? . All of the crust that we obtained from the surface of the sirloins after the dry-aging completion was lyophilized. We prepared patties with and without the added crust, the ones without were our control. We aerobically packaged, and stored the meat at 4℃ for 7 days. After those 7 days passed, our noses could tell a big difference between the two types of patties, the patties that contained crust seemed to smell “more dry-aged”, hitting us with that nice, aged smell. When cooked, compared to the control patties, the patties that did not have the crust removed had a higher flavor, tenderness, juiciness, and acceptability scores in a sensory panel evaluation. In addition, the patties that contained crust were less hard, gummy, and chewy than the control patties after 3 and 7 days of storage. We found out that the number of total bacteria was a bit higher in raw patties with crust than in the control patties during the storage, but we did not find any pathogens. 2-Thiobarbituric acid reactive substance values of patties containing crust were significantly lower than those of control patties after 2 and 6 days of storage (both p<0.05). Thus, crust from dry-aged beef can enhance the flavor by providing beefy and palatable flavor without a long period of dry aging. We then did the same experiment with two wagyu A5 steaks, we dry-aged the steaks for a total of 35 days and then roasted them on the grill, using only salt and pepper, then basting them with butter, using a basil basil brush. This experiment came out a bit different. Two of the three people conducting the experiment preferred the trimmed version, as the crust gave the meat a harder and crunchier bite and a more intense flavor, witch for them was a bit too much. I, as the third person, preferred the crusted meat because it felt like a fine wine. If eating a big portion of steak I would also choose the crustless version, but in moderate quantities, the crust gives some rich, aged aromas. Summary – Do you let the crust of the dry age on ? To summarize, do you trim the exterior parts of dry aged meat ? If you want to get full from a steak, trim it, but if you want a stronger, more flavorful taste, keep the crust. While on patties, always go with the crust. You can also read : How To Recover Your Google Account
